Plaintiff Federal Trade Commission filed suit against Consumer Defense LLC in relation alleged violations of the Federal Trade Commission Act and alleged violations of the Mortgage Assistance Relief Services Rule.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended defendants operated a scheme that deceived financially distressed homeowners by falsely promising to make their mortgages more affordable. Plaintiff contended defendants charged consumers for illegal advance fees and unlawfully told consumers not to pay their mortgages or communicate with lenders. Further plaintiff contended defendants deceived consumers when they used unlawful marketing tactics and practices in connection with the sale of mortgage assistance relief programs.
DEFENDANTS' CONTENTIONS: Defendants denied plaintiff's contentions.
Result
The court granted plaintiff FTC's motion for summary judgment.
