Facts
Decedent Sook Chung, 90, was seated in the passenger seat of a vehicle operated by In Sun Kwon when the vehicle crashed into a tree. As a result of the collision, decedent suffered injuries to her neck, sternum, ribs and back. Decedent was initially hospitalized but died two weeks after the collision due to infections and complications. Decedent's husband Hai Chung, and her four daughters, Susan Chung, Shirley Chung, Margaret Prodis and Julie Riddleberger sought recovery directly from Kwon's insurer State Farm Insurance Company for the wrongful death of decedent during the motor vehicle accident.
Contentions
PLAINTIFFS' CONTENTIONS: Plaintiffs contended that the motor vehicle collision involving Kwon and decedent caused decedent's death.
DEFENDANT'S CONTENTIONS: Defendant did not deny plaintiff's contentions.
Damages
Plaintiffs sought damages for medical costs, and pain and suffering.
Result
The parties agreed to settle the claim for the policy limit of $1.25 million.
