Facts

Teresa Smeir was stopped at a red light at the intersection of Carnelian Street and Lemon Ave in Rancho Cucamonga when Natalie Brown's vehicle collided with the side of Smeir's vehicle. Smeir sued Brown but sought to recover her damages directly through Smeir's insurance carrier, American Automobile Association.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant lost control of her vehicle while speeding into a turn at the intersection that the collision occurred in. Plaintiff further contended that defendant negligently operated her vehicle to cause the collision. Plaintiff further contended that the collision resulted in back, neck, and shoulder injuries to plaintiff.

DEFENDANT'S CONTENTIONS: Defendant denied the contentions.

Injuries

Teresa Smeir suffered from cervical strains and an impinge shoulder. Smear also suffered from neck and back pain that required injections.

Result

American Automobile Association settled plaintiff's claims for $100,000.
