Facts

Plaintiff Randy Vorick was riding a motorcycle in the city of La Habra when he collided with a motor vehicle which was being operated by defendant Cecil Cartwright. Defendant was making a left turn from a commercial driveway when she struck plaintiff. As a result of the collision, plaintiff was ejected from his motorcycle, landing on the pavement. As such, he sustained injuries to his chest and ankle. Plaintiff sought recovery from defendant's insurer United Services Automobile Association (USAA).

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant was negligent in operating her vehicle as she was coming out of a commercial driveway.

DEFENDANT'S CONTENTIONS: Defendant denied the contentions. Defendant claimed that plaintiff contributed to his injuries because he was speeding and made a quick lane change just a few minutes before her vehicle struck plaintiff's motorcycle.

Result

Defendant's insurer, USAAA tendered its policy for $1 million coverage.
