Plaintiff, the District Attorney of the County of Alameda along with several other district attorneys and city attorneys in California filed a complaint on behalf of the People of the State of California against defendant Walgreen, Co., for Health and Safety Code violations.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff alleged that defendant unlawfully disposed of hazardous waste.
DEFENDANT'S CONTENTIONS: Defendant denied plaintiff's contentions.
Result
Defendant agreed to pay $2.8 million dollars as civil penalties pursuant the Health and Safety Code Sections 25189 and 25515. Defendant also agreed to pay $300,000 for supplemental environmental projects. Moreover, defendant will pay $400,000 for reimbursement for attorney's fees and costs. In addition, defendant agreed to transport all hazardous waste materials to an authorized location in California in accordance to Health and Safety Code Section 25189.5. Defendant also agreed to train its employees to ensure compliance with environmental, health, regulatory and safety matters related to disposing of hazardous waste.
