Facts
Juan Sanchez was operating a vehicle near the intersection of Western Avenue and Carson Avenue in Torrance. At the same time, Mario Rivera was attempting to make a U-turn from the northbound side of Western Avenue. The two vehicles collided and Sanchez sought recovery directly from Rivera's insurer, Great American Insurance Group.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiff contended that defendant was liable for the damage that occurred as a result of the collision. Rivera negligently operated his vehicle while making a U-turn at an inopportune moment. Moreover, as the operator of a waste-dump truck, Rivera should have exhibited more caution driving.
DEFENDANTS' CONTENTIONS: Defendants denied the contentions and contended that plaintiff failed to avoid the vehicle he clearly saw turning. Nonetheless, defendants agreed to settle the claims in lieu of further litigation.
Injuries
Juan Sanchez suffered a disc bulge at L5-S1 and endured epidural steroid injection at L5-S1, among other procedures.
Result
The claims were mediated and the parties entered a $550,000 agreement to cover approximately $6,176.90 damages to Sanchez's vehicle and $188,000 in past medical expenses.
