Facts
In March 2016, 21st Century Oncology, a cancer treatment center announced that it suffered a data breach on October 3, 2015 where unauthorized individuals obtained approximately 2.2 million of 21st Century patients' personal identifiable information and health information. Plaintiffs, numerous legal consumers filed a class action lawsuit against defendant 21st Century Oncology in relation to the data breach.
Contentions
PLAINTIFF'S CONTENTIONS: Plaintiffs contended that defendant failed to prevent the 2016 data breach which leaked millions of consumers' private information to unauthorized persons, including their names, social security information, medical diagnoses, treatment information and insurance information.
DEFENDANT'S CONTENTIONS: Defendant denied plaintiff's contentions.
Result
The district court preliminary approved the class action settlement for $12.5 million.
