Facts

Plaintiff James Barr filed a class action on behalf of himself and those similarly situated, against Defendants Drizly, LLC f/k/a Drizly, Inc. and The Drizly Group, Inc. when his personal information was compromised after a data breach by a third party on Defendants' websites.

Contentions

PLAINTIFF'S CONTENTIONS: Plaintiff contended Defendants failed to safeguard and protect its customers' highly sensitive and personal information as evidenced by the data breach. Plaintiff contended Defendants exposed its customers' information to a black market where illegal commerce occurs such as buying and selling stolen cards and identity. Plaintiff further contended as a result of Defendants actions, Plaintiff's personal information has been available to cybercriminals since at least February 13, 2020. Plaintiff additionally contended he sustained immediate, tangible injury as a direct result of the data breach.

DEFENDANTS' CONTENTIONS: Defendants denied Plaintiff's contentions and argued the information acquired by hackers included only customer email addresses, dates of birth, passwords, and delivery addresses.

Result

The parties agreed to settle for $7,100,000.
