Facts

On January 24, 2020, Richard Bothman, 90, was struck by a truck while walking towards his vehicle at a Sprouts grocery store parking lot. Bothman suffered injuries to his face, an elbow, and both legs. Bothman filed suit against Joseph Levine, the driver of the truck, and sought direct recovery from Levine's insurance provider, Allstate Northbrook Indemnity Co. Bothman sought recovery for medical costs, rent for an assisted living facility he had to move to for his physical therapy, and pain and suffering.

Contentions

PLAINTIFFF CONTENTIONS: Plaintiff contended that defendant was negligent in the operation of the truck.

DEFENDANT CONTENTIONS: Defendant did not contest liability and claimed he continued driving after the accident because he was unaware that he knocked Bothman to the ground due to the height of his truck, then he pulled over to help Bothman once he heard people yelling.

Result

The case settled for $1.25 million.
