Facts

Plaintiff Beverly Garver Adams tripped and fell on a city sidewalk. She sued the city and the Empress Hotel who installed the stamped concrete detail in the sidewalk that allegedly caused the injury, alleging the sidewalk was a safety hazard.

Injuries

Injuries included loss of sight to the right eye and traumatic brain injury. Medical specials were $409,933.88 and plaintiff alleged the need for continuing medical and assisted living care.

Result

The case settled for $1,925,000.

Other Information

The City of San Diego did not contribute to the settlement and was dismissed from the case following mediation with neutral Peter Searle.
