On May 31, 1992, the plaintiff, Rosemarie Silvis, a 52-year-old part-time sales clerk and homemaker, was traveling west on Palmdale Boulevard. She was intending to merge onto Highway 138 in Palmdale. The defendant was traveling behind the plaintiff and struck plaintiff's vehicle from behind while traveling at three to five mph. The plaintiff's vehicle was stopped at the time of the accident. The plaintiff brought this action under a negligence theory of recovery.
