On January 1, 1994, plaintiff Jeana Bell, a 34-year-old model/actress, and the defendant, Gregory Spangler, were snow-skiing at Heavenly Ski Resort in South Lake Tahoe. The defendant was traveling at an unsafe and excessive speed, out of control, and he unlawfully attempted to overtake/pass plaintiff while failing to yield to her the right-of-way which she had as the down-hill/down-slope skier. Defendant hit plaintiff from above and behind. The plaintiff brought this action against the defendant based on negligence theories of recovery.
