On Feb. 17, 1993, plaintiff David Troiani, a 38-year-old chief mate on the defendant's oil tanker, was injured while lettin go of the mooring lines at defendant Arco Marine Inc.'s dock at Cherry Point, Wash. Mixed mooring lines, composed of two wire spring lines and one poly line, were being used. The plaintiff observed tension on the poly line due to ship movement, creating a potential danger of snap-back to the vessel and crew. The plaintiff allegedly injured his back when he bent over a mooring bit and lifted the poly line to slack it off before it could snap. The plaintiff brought this action against defendant Arco Marine, Inc., the owner of the oil tanker and the dock, based on negligence and maritime theories of recovery.
