On Sept. 12, 1993, plaintiff Lois Matsumoto, a 59-year-old secretary, was injured when her vehicle was rearended by a bus operated by defendant Sandra Ann Graham, while in the course and scope of her employment with defendant Santa Clara County. The plaintiff was stopped at a red light when the bus struck her vehicle at 40 to 45 mph. The collision pushed the plaintiff's vehicle forward approximately 300 feet. The defendant driver died before trial from unrelated causes. The plaintiff brought this action against the defendants based on negligence and respondeat superior theories of recovery.

Settlement Discussions
