On Nov. 21, 1993, plaintiff Wilfred Gagnon, was working at Bill Murphy Buick, Inc. The plaintiff claimed the security gate at the dealership fell off its rollers while he was attempting to close it. The plaintiff claimed the gate fell on him knocking him to the ground. The plaintiff claimed that on March 24, 1994, the security gate again fell off its rollers and onto him while he was attempting to close it but that some employees helped him remove the gate from his person before he fell to the ground. The dealership premises were owned by Bill Murphy individually and leased to the corporation. The plaintiff brought this action against William Murphy, individually, based on negligence and premises liability theories of recovery.
