On March 26, 1994, plaintiff Julie Behrens, a volunteer paramedic, was shopping in a defendant Wal-Mart store in Aurora when merchandise allegedly fell from an overhead shelf and struck her in the back of the head and the neck. The merchandise that fell weighed 50 pounds. The plaintiffs, the customers and her husband, brought this action against the defendant based on negligence, premises liability and loss of consortium theories of recovery.
