Facts

On March 14, 1993, plaintiff Todd G. Vecellio, a 24-year-old motorcycle salesman, was riding a motorcycle when it collided with a car driven by defendant Elizabeth Wynkoop. The plaintiff was traveling westbound on Lake Avenue. The defendant was traveling southbound on Southgate Road and made a right turn to proceed west on Lake. The plaintiff claimed that the defendant proceeded from the merge lane across the right lane and into the left lane in front of his motorcycle. The plaintiff, riding his motorcycle in the left lane of Lake Avenue, struck the left rear corner of the defendant's automobile. The plaintiff brought this action against the defendant based on a negligence theory of recovery.

The plaintiff made a settlement demand for $100,000. The defendant made a settlement offer of $50,000.
