Facts
On Aug. 20, 1993, plaintiff Gary Seifert, a 30-year-old technical communications specialist, was a passenger in a Corvette driven by defendant Terry Clemmer. The plaintiff claimed the Corvette left the roadway after the defendant attempted to pass another vehicle. The Corvette struck a utility pole. The Corvette was destroyed and the defendant was severely injured. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
Settlement Discussions
The plaintiff made a settlement demand for $22,500 to $25,000. The defendant made a statutory offer of compromise for $12,500.
