Facts
Naliza Gomez and her mother, Michele Herrera, alleged that Naliza sustained injuries while riding a school bus
driven by Edward Quick and owned by Boulder Valley School District.
The plaintiffs claimed that as the bus drove around a corner, Gomez slid from her bus seat and struck her head
on a metal bar underneath the seat. Plaintiff Gomez alleged injury to C1-2 requiring spinal fusion surgery, pain
and suffering, emotional distress and loss of educational opportunity. Plaintiff Herrera claimed economic losses
as a result of her daughterÆs injuries.
The defendant denied negligence and disputed the nature and extent of the minor plaintiffÆs injuries and
plaintiffÆs damages.
Settlement Discussions
The plaintiff demanded $95,000 before trial. The defendant offered $25,000 to Gomez and $1,001 to Herrera before trial.

GomezÆs suffered cervical spine requiring surgery.
