Facts
On Oct. 21, 1997, Kimberly Springer was in an auto collision at 13th and Race Streets in Denver. She had
stopped behind a 1995 Ford Windstar van when Matthew LindgrenÆs vehicle struck her from the rear. Springer
alleged that her vehicle was forced into the Ford Windstar.
The court directed a verdict in favor of the plaintiff on the issue of liability.
Settlement Discussions
There was a $10,000 final demand before trial and a $5,000 statutory offer of settlement according to the defendantÆs attorney.
Damages
The Ford Windstar van sustained approximately $700 in damages, and the Springer vehicle sustained $3,679 in damages. Immediately before trial, the plaintiff dismissed her negligent entrustment and family car doctrine claims against Kathy Lof.
Injuries
The plaintiff claimed neck and back pain, and permanent psychological injuries, The PIP carrier paid medical expenses of $13,382.
Other Information
The jury found that although the plaintiff had suffered damages they were not caused by defendantÆs negligence.
