Facts
On Jan. 16, 1997, plaintiff Patricia Schott, claimed she stopped her vehicle on West Coal Mine Road and was
exiting when the defendant backed his vehicle into the front of her vehicle.
Injuries
The plaintiff claimed neck and closed head injuries. PIP carrier paid medical expenses in excess of $43,000. During closing the plaintiff requested damages in excess of $500,000.
Result
The jury determined that the plaintiff had injuries, damages and losses, and the defendant was negligent and his negligence was a cause of the plaintiffÆs injuries, but awarded no damages. The defendant filed a bill of costs for $22,235. The plaintiff filed a motion of judgment notwithstanding the verdict, amendment of findings regarding damages or a new trial on damages, and is contesting defendantÆs bill of costs.
