Facts

Douglas Lyle purchased a boat from Mariah Boats Inc. He alleged that the weld in the boatÆs fuel tank failed and Mariah Boats repaired the tank under warranty. There was no charge to the plaintiff. The jury was instructed regarding an exception to the deceptive trade practices section of the Colorado Consumer Protection Act specifically related to advertising.

Settlement Discussions

The plaintiffÆs attorney said that there was $24,000 demanded at mediation. The defendantÆs attorney said there was no final offer before trial. The plaintiffÆs attorney said there was a final offer of $2,500.

Damages

The plaintiff alleged close to $18,000 for the losses caused by the sale of the boat and the leaking gasoline from the fuel tank.
