Facts
The plaintiff Janice Lefler had finished shopping at Home Depot and was waiting in the check-out
line. Her back was turned to a shopping-cart containing believed to be a five-pound one-and-a-
half inch 10-foot long pvc pipe. The cashier moved a box in the shopping cart and the pvc pipe
fell and hit Lefler on the head.
Settlement Discussions
The plaintiff demanded $325,000 at a settlement conference. The defendant then offered $5,000. Prior to the trial, the defendant had filed a statutory offer of settlement of $15,000. The defendant offered $25,000 during the trial.
Injuries
The defendant claimed that she developed a bulging disc at C3-4 level of her cervical spine, which required anterior cervical diskectomy surgery. Following the surgery, her physician Stecher put her in a collar.
