On March 3, 1999, the plaintiff was playing golf at the Sinaloa Golf Course in Camarillo. While standing on the
number 7 tee box sizing up his shot, the plaintiff was struck in the right side of the head near the right eye with
a golf ball hit by another golfer from number 4 tee.
Settlement Discussions
The defendant offered $1,500 before a complaint was filed and $2,500 per C.C.P. Section 998 on Sept. 9, 2000. The plaintiff demanded $75,000. On Jan. 9, 2001, the parties agreed to a binding arbitration with a minimum award of $15,000 and a maximum award of $75,000. Prior to arbitration, the plaintiff offered to settle the case for $45,000.

Injuries
The plaintiff suffered a small cut above the right eye which required 3-5 sutures, an ocular contusion subconjunctival hemorrhage and retinal hemorrhage. The plaintiff experienced headaches for approximately five months following the injury. He also experienced small floaters in the vision of his right eye when he looks to the right. In the opinion of the plaintiffÆs expert, the floaters are permanent.
