The plaintiff, an African-American male, was employed by CP Kelco as a Level II Operator for almost nine years when he was discharged for performance reasons. He brought an action against CP Kelco for discrimination, retaliation, and racial harassment. His supervisor, Cesar Martinez, was sued only for racial harassment.
Settlement Discussions
A court-ordered mediation before Michael Bergner was unsuccessful, and the plaintiff thereafter refused the defendants' overtures to engage in settlement negotiations.
