Facts

The will of the decedent, Harold Kramer, was admitted to probate on May 15, 2002. The contestant, Milton Kramer, requested a copy of the Inventory and Appraisal from the respondent's attorney and was promised a copy when completed. Due to the complications of dealing with 19 banks and 55 bank accounts, the respondent filed his Inventory and Appraisal on May 23, 2003. After receiving a copy of the Inventory and Appraisal, the contestant filed a will contest on July 18, 2003, 429 days after the will had been admitted to probate.

Result

The Contestant, Milton Kramer, was barred from contesting the decedent's will due to 120-day statute of limitations in Probate Code Section 8270 (a).
