Leonardo Salinas Jr. was driving with his father, Leonardo Salinas Sr., as a passenger. A vehicle driven by Melissa Aebly (erroneously sued as Melissa Laebly) collided with the Salinas' vehicle. The Salinas' filed suit against Aebley and Betty Schmidt, a partial owner of the vehicle.

CONTENTIONS:
Plaintiffs claimed Aebly was negligent in the operation of her vehicle. They also alleged that she was acting in the course and scope of her employment at the time of the accident. Defendants denied liability and contended that the accident was the result of the plaintiffs' negligence.
