Facts
This case arises out of an accident that occurred between an automobile and a pedestrian on July 1, 2003. Plaintiff Arlene Brundage, her husband, and dog were walking east on Mayerling, approaching the intersection with Shochone in the city of Northridge. Defendant Danielle Vitale was operating her 2000 Volvo traveling westbound on Mayerling intending to turn left on Shoshone. The intersection is controlled by a four way stop sign. Mr. Brundage was walking ahead of his wife and had already begun to cross the street before the accident occurred. Mrs. Brundage was walking her dog and trying to train it. She stopped with the dog at the intersection and saw that Volvo stopped at the intersection. She proceeded to cross the street with her dog when all of a sudden, the Volvo appeared and struck her on the left side, knocking her to the ground and rendering her unconscious.
