Facts

Jin Giang Li was driving a van owned by his employer, Win Kee Food Products, during the course and scope of his employment, through a parking lot. The van collided with the driver's side of a car driven by Ruo Hong Li. Ruo Li filed suit against Win Kee and Jin Li. Her husband, Yu Dong Zhong, also filed suit for a loss of consortium.

Contentions

PLAINTIFF'S CONTENTIONS:
The plaintiff claimed that she was driving on the parking lot access road, and that the accident had occurred as she was making a right turn off the access road. She alleged that Jin Li had been driving through empty parking spots and struck her while she had the right of way.

DEFENDANTS' CONTENTIONS:
The defendants claimed that Jin Li had the right of way and denied liability. They also claimed that plaintiff had sought excessive treatment for her injuries.

Damages

The plaintiff sought $35,000 for her pain and suffering, medical expenses, lost wages and lost use of property.

Injuries

The plaintiff sustained soft-tissue injuries to her back and neck, as well as a non-fracture injury to her left knee. She underwent six months of chiropractic care for her injuries.

Result

The parties settled for $17,500, and Zhong dropped his loss of consortium claim.
