Plaintiff Celerity Inc. is a Milpitas-based company that provides advanced gas panels and instruments for use with semi-conductor manufacturing equipment. The plaintiff sent letters to defendant Ultra Clean Technology Systems & Service Inc., claiming that the company had infringed upon plaintiff's patents.
The defendant contended that its product, Predator IGS, did not infringe upon plaintiff's patents. Further, according to defendant, plaintiff's patents were invalid.
Damages
Plaintiff sought $13,900, which was comparable to an eight percent royalty rate on all of defendant's Predator IGS sales.
Result
The jury found that defendant's product infringed on one of plaintiff's patented modular gas delivery technologies, but did not infringe on the other patent. The patents were not found to be invalid. Plaintiff was awarded $13,900.
