Nerses Beranyan, 85, was hit by a car driven by Patricia West. Her passenger side rearview mirror struck Beranyan's back. Beranyan sued West for motor vehicle negligence.

The defendant contended plaintiff did not use the crosswalk and was wearing dark clothes. She proceeded at 35 miles per hour and did not see plaintiff crossing an unmarked area carrying a black trash bag at night.
