Katherine Walters and William Weidman fought with their brother, George Weidman, over their stepfather's money. After Walter Spengler passed away, George brought numerous lawsuits challenging his estate plan. He asked his brother and sister to sign a stipulation for settlement to resolve the dispute. Walters and William Weidman brought a breach of contract claim against George to share the proceeds from the settlement pursuant to their agreement.
Contentions
PLAINTIFFS' CONTENTIONS:
The plaintiffs contended they signed the stipulation in exchange for defendant's agreement to share the proceeds of the settlement equally. Instead, defendant breached the contract setting forth equal distribution of recovery.
DEFENDANT'S CONTENTIONS:
The defendant denied the existence of such an agreement and contended he owed nothing to plaintiffs.
Result
The plaintiffs were awarded $100,000 each plus 50 percent of any future settlement proceeds, plus costs and prejudgment interest.
