Craig Hummel, a Watson Realty real estate broker, solicited companies interested in selling property. Wagih Michael, president of National Health Services Inc. (NHS), informed Hummel he would consider offers. Standard Management Co. (SMC) offered to purchase the NHS property for $400,000 and NHS submitted a counter-offer for $550,000. SMC accepted the counter-offer. It sued NHS when the sale fell through.
Contentions
PLAINTIFF'S CONTENTIONS:
The plaintiff contended that although the property was worth $1.4 million at the time of the contract, it was valued at $200,000 once trial started.
DEFENDANT'S CONTENTIONS:
The defendant contended the contract was void because defendant never authorized Hummel to enter a sale on its behalf.
