Plaintiff Yaffa Amzallag leased a studio apartment in Los Angeles, California, in a complex that had been converted from a hotel. The 50-year-old complex was owned by defendants Beverly Grigsby, Cynthia Bury, and Robert Pinsky, and managed by defendant The Beaumont Management Company Inc. (BMC).
Contentions
PLAINTIFF'S CONTENTIONS:
Amzallag contended her unit was an illegal, unregistered unit with water problems resulting in mold. The water problems included a leaking sink and drainage issues from a defective shower drain. The water problems caused the mold, which defendants failed to remedy. Amzallag argued that prior tenants had made similar complaints but the defendants were unwilling or unable to repair the problems despite repeated entreaties.
DEFENDANTS' CONTENTIONS:
The defendants denied all allegations.
Injuries
Amzallag claimed to suffer mold-related injuries including problems with breathing, joint pain, memory loss, brain damage, burst appendix, headaches, allergies, dizziness, abdomen pain, carpal tunnel syndrome, and ulnar neuropathy.
Result
The jury found for Amzallag in the amount of $1,478,926. BMC was assigned 70% responsibility with 30% assigned jointly to the other defendants.
