Facts

On Nov. 2, 2003, police officer Doug Jauch responded to a complaint alleging that Thomas and Brenda Phillip refused to leave a restaurant. When Jauch arrived, he noticed that they were intoxicated and observed Thomas harassing a patron. Thomas refused to cooperate, resulting in his arrest. In making the arrest, Jauch used pepper spray and the K-9 on Thomas. Later, the couple brought an action for false arrest and excessive force.

Result

The jury returned a verdict in favor of the defense.
