In 2005, Mary Schneider suffered a hip injury while exiting an elevator at The Broadmoor Hotel, a retirement hotel in San Francisco where she resided. In 2005, she suffered from shingles and increased dementia. The next year, she died as a result of infected bedsores. Schneider's son, Richard Schneider, sued The Broadmoor Hotel and the city and county of San Francisco claiming that the defendants failed to exercise proper care, and alleging elder abuse, wrongful death, and survivorship.

PLAINTIFF'S CONTENTIONS:
The plaintiff claimed that the defendants knew of Schneider's condition but failed to properly care for her.

The plaintiff claimed death.
Result
The jury awarded the plaintiff $82,633 as against the city and county of San Francisco. The jury also found plaintiff Richard Schneider was comparatively negligent and 80% responsible for his mother's death. The court subsequently reduced the award to $16,526.63.
