On Aug. 3, 2006, a tree branch allegedly fell on Linda Constant's foot. As a result, she sued the government for negligence.

PLAINTIFF'S CONTENTIONS:
Constant claimed that the United States of America was responsible for managing the site from which the branch fell.

The government denied liability.
