In May 2007, the Los Angeles Harbor Dept. hired 58-year-old Tony Pool to work as a programmer analyst. Six months after being hired, the Harbor Dept. terminated Pool's employment. Pool sued the City of Los Angeles, alleging age and disability discrimination.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff claimed that the City fired him due to his age and because he had diabetes.

DEFENDANT'S CONTENTIONS:
The City claimed plaintiff was given repeated counseling, but that plaintiff did not have the required analytical skills for the position and continued to have negative performance evaluations.

Damages

Plaintiff requested $500,000.

Result

The jury found in favor of the defense.
