In 2002, plaintiff Business to Business Markets Inc. hired defendant Kshema Technologies Ltd. to design a website to be used as a business aid for textile and furniture companies to interact with each other.

Business to Business filed suit against Kshema, MphasiS Corp. and MphasiS BFL Ltd., alleging breach of contract.

Contentions

PLAINTIFF'S CONTENTIONS:
Business to Business contended that Kshema failed to fully develop a functional website in violation of their contract.

DEFENDANT'S CONTENTIONS:
Kshema denied any breach of contract. Kshema alleged Business to Business had not suffered damages, having already recovered its costs to complete the website agreement in a separate litigation.
