Facts

On Nov. 13, 2007, Peter Gabriele was driving on Mission Boulevard when Peggy Duncan exited a parking lot, turning left onto Mission. Duncan's vehicle collided with Gabriele's vehicle when Duncan drove in between two tractor-trailers, which had come to a stop. On Feb. 5, 2008, a vehicle operated by Sam Abraham rear-ended a vehicle driven by Gabriele. Gabriele filed a lawsuit against Duncan and Abraham, alleging motor vehicle negligence. Abraham's insurer subsequently settled with Gabriele.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff argued that Duncan should not have turned left before the tractor-trailers passed, and that if she had waited for them to pass, her view would have been clear. Further, plaintiff argued that Abraham negligently maintained his view and failed to decrease his speed or maintain an appropriate distance between vehicles.

Injuries

Plaintiff suffered an abdomen injury, contusions, headaches, a herniated disc at C6-7, neck injury, pelvis injury, and numbness.

Result

The jury awarded plaintiff $5,262.
