Facts

Marilyn Meis underwent substantial elective plastic surgery on May 16, 2007, which was performed by Robert Hardesty. The surgery included multiple procedures including breast augmentation, mastopexy, capsulecomy, thighplasty, and liposuction. Subsequently, on June 20, Meis was taken to the emergency room and diagnosed with severe anemia and septic shock, and died three days later.

Contentions

PLAINTIFF'S CONTENTIONS:
Meis's family filed suit against Hardesty, alleging he failed to diagnose Meis's infection during checkups following surgery.

DEFENDANT'S CONTENTIONS:
Hardesty contended that Meis's wounds did not show signs of infection, and she refused to be admitted to the hospital for pain management upon his suggestion.

Result

The jury rendered a verdict for the defense.
