Facts
Juana Garcia was admitted to Hollywood Presbyterian Medical Center to deliver her child, Anthony Hernandez. Because of the baby's size, the delivering physician had difficulty delivering the baby.
Dr. Arjang Naim delivered the child using a vacuum suction as opposed to a cesarean section. As a result, the child suffered severe birth trauma and severe and permanent left brachial plexus paralysis, left clavicle fracture, and other neurological injury.
The child, through his guardian ad litem, sued Hollywood Presbyterian, Dr. Naim and Teresa Medical Center for negligence.
Result
The parties agreed to settle for $350,000.
