Facts

The Citizens Climate Lobby filed suit arguing that regulators incorrectly interpreted AB 32 and thus created carbon offset regulations that were environmentally inadequate, would undermine the state's greenhouse gas reduction goals, and that were therefore invalid.

Result

The Court upheld the validity of the offset regulations, finding that the regulators properly implemented AB 32 and acted within their powers when including the offset provisions in the state's Cap and Trade Program.
