Facts

Peter Arth, the former mayor of Dunsmuir, filed a lawsuit accusing four City Council members of making decisions that benefited them financially. Arth accused council members Nick Mitchell, Chris Raine, Diane Dolf, and Arlis Steele of conflicts of interest resulting from votes to settle a lawsuit in 2010 with Citizens for a Better Dunsmuir. The council members were all members of the group involved in lawsuit and received its endorsement in a previous election.

Arth alleged that the council members refused to state reasons for why they sat out a decision to settle a different lawsuit, then voted after recusing themselves to change a previous decision, and that the members further violated the Brown Act by attending a meeting of Citizens for a Better Dunsmuir and discussing City business.

Result

The Court denied all of Arth's claims, finding no evidence that his allegations were true.
