Facts

On Aug. 6, 2010, Darin Blue, while skateboarding, entered an uncontrolled crosswalk and struck the side of Joshua Schwab's SUV, who was driving through. Blue filed suit, arguing that Schwab had failed to yield the right of way.

Schwab argued that Blue had run into the side of the vehicle and was entirely responsible for the accident.

Damages

Blue claimed $11,500 in past medical damages and $27,000 in future medical damages.

Injuries

Blue suffered a fractured cheekbone, broken teeth, and assorted scrapes and bruises.

Result

The jury awarded Blue $59,742. However, it found that Blue was 30 percent contributory negligent and reduced the award to $41,819.
