Facts
Graciela Lopez and Jose Lopez filed a lawsuit against the City of Los Angeles and Robert Kraus in relation to an accident involving a bicycle and an automobile.
Contentions
PLAINTIFF'S CONTENTIONS:
On March 29, 2012, Graciela was riding a bicycle and was hit by a vehicle driven by Kraus. She alleged Kraus was trying to turn right at an intersection and the city owned the vehicle he was driving. Graciela argued that Kraus drove negligently and that the city should be held liable as well.
DEFENDANT'S CONTENTIONS:
Defendants contended that had Graciela performed certain exercises, she would not have needed the manipulation procedures she received. In addition, they contended that she did not need treatment in the future.
Damages
Plaintiff Graciela Lopez requested $228,036 in past medical costs.
Injuries
Graciela suffered a decreased range of motion, frozen shoulder, medical meniscus tear, and release of her patellar tendon, rotator cuff injury, cervical strain and tendonitis. She required arthroscopy, decompression surgery, meniscectomy and synovectomy.
Result
The parties agreed to settle for $600,000 during mediation.
