Facts
Elise Guthmann sued Landon Poff, Keith Brown, and Audrey Shirmer, based on a personal injury accident that occurred on April 10, 2010.
Contentions
PLAINTIFF'S CONTENTIONS:
Guthmann contended that as she was leaving a restaurant, a car hit her. Although Guthmann was injured, she had difficulty identifying whether a car driven by Poff or a car driven by Brown had hit her. Guthmann then sued Poff, Brown, and Shirmer, the owner of Brown's vehicle. She argued that both drivers were negligent, and that Shirmer was also responsible for the accident.
DEFENDANT'S CONTENTIONS:
Brown denied hitting Guthmann, arguing that he had swerved his vehicle to avoid hitting Poff, but did not collide with Guthmann.
Poff argued that Brown had hit Guthmann, and denied doing so himself. Instead, he claimed that Brown had been speeding and lost control of his vehicle, causing the accident. Poff settled with Guthmann prior to the case, leaving only Guthmann's claim against Brown.
Injuries
Guthmann fractured her right food, requiring multiple surgeries.
Result
Poff settled with Guthmann for $15,000. The other parties later settled with Guthmann for $110,000, bringing her total award to $125,000.
