Anthony Held filed suit against CSS Inc., claiming violation of Proposition 65.

Contentions

PLAINTIFF'S CONTENTIONS:
Held alleged that CSS manufactured, imported, or distributed pliers with vinyl/PVC grips that contained DEHP. Proposition 65 has listed DEHP as a chemical known to cause reproductive harm, and requires warnings.

Result

The parties entered into a consent judgment. CSS agreed to new reformulation standards, where its products would contain less than 1,000 parts per million of DEHP. CSS also agreed to pay $40,000 in civil penalties, and $40,000 to Held for his fees and costs.
