Deckers Outdoor Corp. sued Binder Production Pty Ltd., doing business as Jumbo UGG, for trademark infringement and other causes of action.
Contentions
PLAINTIFF'S CONTENTIONS:
Deckers argued that Jumbo infringed on its trademarks by selling unlicensed, counterfeit products bearing Deckers' trademarks and patented designs. Jumbo were sellers and advertisers of counterfeit footwear and footwear products. While Decker adopted and used the trademark "UGG" for its own goods, Jumbo unlawfully used the same trademark on its own products. Deckers argued that this was likely to cause confuse consumers, harming Deckers.
Result
The court granted a permanent injunction against Jumbo, prohibiting it from violating Deckers' trademarks and patents.
