Facts

Laurence Vinocur filed a complaint against True Design Inc. and other defendants, including The Music People, claiming they were in violation of Proposition 65.

Contentions

PLAINTIFF'S CONTENTIONS:
Vinocur accused The Music People of manufacturing, selling, or otherwise making available in California, products with foam cushion components that contained the chemicals TDCPP and DEHP, without the requisite Proposition 65 health warnings.

DEFENDANTS' CONTENTIONS:
The Music People denied Vinocur's allegations and maintained its compliance with applicable laws and regulations.

Result

The Music People agreed to enter into a consent judgment with Vinocur, which provided for injunctive and monetary relief. As part of the injunctive relief, The Music People agreed to manufacture or sell only reformulated products and provide the requisite warnings. In addition, The Music People also agreed to pay $20,000 in civil penalties, and $35,000 in fees and costs.
